How does divorce by mutual consent work?

It can be carried out at the Civil Registry Office if there is an agreement on the divorce, the destination of the family home, maintenance and the regulation of parental responsibilities.

What is the regulation of parental responsibilities?

It is the legal process that defines custody, the visitation regime and the amount of maintenance for children in case of separation of parents.

How is an inheritance divided if there is no agreement?

If there is no agreement between the heirs, it is necessary to resort to the inventory process, which can be notary or judicial, to carry out the division of assets.

Is a foreign will valid in Portugal?

Yes, provided it complies with the formal requirements of the place where it was made or the national law of the testator, but it may need to be validated or transcribed.

What are the rights in a de facto union?

After 2 years of living together, the members of the de facto union have rights similar to married couples in terms of tax, housing and, in some cases, social security, but not automatic inheritance rights.

Can I choose which law applies to my succession?

Under the European Succession Regulation, it is possible, in certain cases, to choose the law of nationality to govern the succession, which is particularly relevant for foreign residents in Portugal.
